AI Is More Prone to Imposing Death Penalties on Defendants Writing in African American Vernacular English

Recent studies indicate that AI chatbots are inclined to prescribe capital punishment more frequently when presented with content written in African American Vernacular English (AAVE) relative to standardized American English. Furthermore, AI models associate AAVE speakers with less esteemed professional positions. Typically, AAVE is utilized predominantly by African American and Canadian individuals.

This investigation, currently awaiting peer review, highlights implicit racism ingrained in AI by examining its reactions towards distinct variants of English. Up until now, the bulk of racism-related research focusing on AI has emphasized overt forms of discrimination, exemplified by AI chatbot responses to the term ‘Black.’

Valentin Hofmann, one of the report’s co-authors, shared that, “Compared to human biases against African Americans documented in experiments, the covert racism exhibited by AI models towards African American English surpasses negativity.” He added, “Upon direct questioning, AI models typically attribute favorable qualities to African Americans, such as intelligence and enthusiasm. However, when exposed to dialects like AAVE, profoundly embedded stereotypes emerge unexpectedly.”
